1. Introduction & Legal Entity

Welcome to The Korean House (accessible at thekoreanhouse.in and thekoreanhouse.com, referred to hereafter as “The Korean House”, “we”, “us”, or “our”). We are a boutique lifestyle and curated gifting business operating from Bandra, Mumbai, Maharashtra, India.

These Terms of Service (“Terms”) govern your access to and use of our website, mobile interface, shopping cart, checkout system, and associated services. By browsing our website, registering an account, or purchasing merchandise, you signify your unreserved consent to these Terms and our companion Privacy Policy.

2. Eligibility & Account Security

Under the Indian Contract Act, 1872, you must be at least 18 years of age and legally competent to enter into binding agreements to place an order on this website. If you are under 18 years of age, you may use our platform and browse products solely under the direct supervision of a parent or legal guardian who agrees to be bound by these Terms.

If you create a customer account, you are solely responsible for safeguarding your login credentials, password, and session integrity. You agree to notify us immediately at hello@thekoreanhouse.in of any unauthorized access or breach of security. The Korean House will not be liable for losses arising from compromised customer credentials.

3. Product Authenticity, Sourcing & Descriptions

The Korean House specializes in hand-curated lifestyle goods, aesthetic stationery, Korean toys, plushies, and K-fashion items imported from Seoul, South Korea or sourced through authorized channels.

4. Pricing, Taxes & Erroneous Listings

All prices displayed on the website are denominated in Indian Rupees (INR / ₹). Prices displayed on product pages are inclusive of applicable Goods and Services Tax (GST) unless stated otherwise. Applicable shipping charges are computed and presented transparently prior to payment confirmation.

Pricing or Typographical Errors: Despite our best efforts, inadvertent typographical errors, database inaccuracies, or technical glitches may lead to an incorrect price being published. The Korean House reserves the absolute right to cancel, refuse, or rescind any order placed for a product incorrectly priced or listed with erroneous stock availability. In the event your payment has already been collected for a cancelled order, we will issue a full, prompt refund back to your original payment method.

5. Order Acceptance & Payment Processing

Placing an order constitutes an offer to purchase. An order is deemed accepted by The Korean House only when your payment is successfully authorized and an official Order Confirmation with an assigned Order ID is dispatched to your registered email address.

Online transactions are processed securely through our RBI-authorized, PCI-DSS Level 1 compliant payment gateway partner, Razorpay. We accept Unified Payments Interface (UPI via Google Pay, PhonePe, Paytm), major Credit & Debit Cards (Visa, Mastercard, RuPay, American Express), and Net Banking. We do not store sensitive payment card credentials or UPI PINs on our servers.

6. Shipping, Risk of Loss & Title

Orders are packed and dispatched from Mumbai, India to destinations across India via third-party logistics partners (e.g., Blue Dart, Delhivery, DTDC, India Post). Full terms regarding dispatch SLAs, shipping charges, and delivery timeframes are set out in our Shipping & Delivery Policy.

Title to and risk of loss for products pass to the customer upon successful physical delivery by the courier partner to the address specified in the order.

7. Intellectual Property Rights

All original content featured on this website — including brand graphics, typography styling, custom layouts, product descriptions, photography, logos, and software code — is the intellectual property of The Korean House and protected under Indian Copyright and Trademark laws.

Third-Party Trademarks: Character names, mascots, and logos (including but not limited to Kakao Friends, Sanrio, LINE FRIENDS, BT21, and related brand names) are registered trademarks and copyrights of their respective owners. Their mention on this platform is purely nominative to describe genuine, licensed merchandise sourced for retail sale.

8. Prohibited Uses & User Conduct

You agree not to exploit the website for any unlawful, deceptive, or abusive purposes, including:

• Transmitting malicious code, bots, viruses, or disruptive scripts.
• Engaging in automated scraping, data extraction, or indexing of product catalogs without explicit written consent.
• Falsifying identity, phone numbers, or delivery addresses during checkout.
• Engaging in payment fraud, unauthorized chargebacks, or coupon exploitation schemes.

9. Disclaimer of Warranties & Limitation of Liability

Except as expressly set forth under statutory consumer protections, this website and all products offered are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.

To the fullest extent permissible under Indian law, The Korean House, its proprietors, affiliates, and representatives shall not be liable for indirect, incidental, punitive, or consequential damages resulting from website downtime, delivery delays attributable to courier disruptions, or force majeure occurrences. In all circumstances, our maximum cumulative liability to any purchaser shall not exceed the amount actually paid by the purchaser for the specific order in dispute.

10. Governing Law & Dispute Jurisdiction

These Terms and any non-contractual obligations or claims arising out of your interaction with The Korean House shall be governed by, construed, and enforced in accordance with the substantive laws of the Republic of India.

Any disputes, legal proceedings, claims, or controversies arising under or in relation to these Terms shall be subject to the exclusive territorial jurisdiction of the competent civil courts situated in Mumbai, Maharashtra, India.

11. Modifications & Grievance Redressal

We reserve the right to revise or update these Terms from time to time. Any material changes will take effect immediately upon posting to this URL, with the “Last Updated” date revised accordingly.
